Ethical Content & Usage Policy
1. Verification-Gate & Legal Precedence
Access to our generative tools is strictly controlled. We only provide generation capabilities to Clubs, Athletes, Agencies and Brands who have been granted explicit permission by the account holders (the Portrayed Personality or their Agency).
- Legal Hierarchy: If any terms in a private agreement between the IP Holder and the Licensee contradict this policy, the terms of that specific agreement shall prevail.
- Proof of Rights: Onboarding is incomplete until a valid Digital Likeness Authorization (DLA) is uploaded and verified by our compliance team.
2. Purpose-Bound Generation (Non-Transferability)
Rights are granted for specific "Intent Categories." Permission is not a blanket license for all uses.
- Contextual Limits: Authorization for a specific use case does not grant rights for a different one. This is strictly controlled. (e.g. endorsement for a product is limited to that brand/product).
- Explicit bounds: Generation is constrained to the specific assets and rights are not implicitly inherited. (e.g. rights to generate images of a player do not carry rights for the player team’s jersey unless specifically approved).
- Verified Asset Recycling: An image generated for Campaign A can only be modified or repurposed for Campaign B with explicit secondary verification of rights for that specific use-case.
3. Ethical Guardrails: Behavioral & Associative Integrity
We strictly prohibit any generation that takes a personality "Out of Character."
This includes, but is not limited to:
- Behavioral Sensitivity: No imagery portraying the athlete partying, using restricted substances, or engaging in "mocking" or derogatory behavior.
- Questionable Associations: Prohibiting the generation of the athlete alongside individuals or entities that could be considered controversial, polarizing, or damaging to the athlete’s public standing.
- Emotional Integrity: Beyond physical distress, we prohibit the simulation of intense negative emotions or vulnerable states that have not been authorized.
4. Authorized Endorsements Only
We do not allow "blind" product placement.
- Whitelisted Brands: The platform will only generate imagery featuring brands, logos, and products that have been explicitly authorized and added to the specific use-case.
- Competitor Protection: Our system is designed to prevent "accidental" endorsement of rival brands (e.g., ensuring a Nike-sponsored athlete is never generated in Adidas apparel).
- Avoid brand simulacra: The platform will reject any non-existing brands, or any recognizable color, style, shape that would be immediately associated with a known brand.
5. Final Sovereignty & Approval
The Portrayed Personality maintains absolute control over their digital self.
- The Final Say: No generated asset may be exported or published without the final digital sign-off of the athlete or their designated representative.
- User Responsibility: The Licensee (User) bears the ultimate responsibility to ensure they have obtained authorization for the specific intended use of any generated assets.
6. Policy Enforcement & Asset Revocation
DHTA reserves the right to immediately suspend access and/or terminate the account of any User found to be generating 'Out of Character' (OOC) content or violating the 'Purpose-Bound' limitations of a DLA.
Upon a verified report of misuse or a 'Takedown Request' from a Rights Holder:
- Immediate Suspension: The specific asset(s) and the User’s generation capabilities for that Talent will be frozen.
- Mandatory Deletion: DHTA will purge the unauthorized assets from its servers and requires the User to provide proof of deletion for any downloaded copies.
- Legal Notification: DHTA will cooperate with the Talent’s legal representation to provide audit logs of the unauthorized generation.
- No Refund: Violations of the Ethical Content Policy forfeit any right to service refunds.
